NZGrader Terms and Conditions

1. About These Terms

These Terms and Conditions ("Terms") govern your access to and use of NZGrader ("the Service"), operated by WordFrame ("we", "us", "our"). WordFrame is a virtual company operating under the Young Enterprise Scheme (YES), a New Zealand secondary school business education programme.

By creating an account or using the Service in any way, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Service.

These Terms are governed by the laws of New Zealand.

2. Who Can Use NZGrader

You must be at least 13 years of age to create an account and use the Service. Users aged 13–17 may sign up directly but by doing so confirm they have obtained the consent of a parent or legal guardian. We reserve the right to request evidence of parental consent at any time.

Users who are 18 or older may sign up without restriction.

By using the Service, you confirm that the information you provide during registration is accurate and complete.

3. Description of Service

NZGrader is an AI-assisted marking and feedback tool designed exclusively for New Zealand's NCEA assessment system. The Service allows teachers to upload student work alongside relevant achievement criteria and receive a suggested grade and draft feedback. Students may also submit draft work to receive a grade estimate and guidance on how to improve.

Important: All grades, feedback, and assessments generated by NZGrader are suggestions only. They are not official NCEA results and carry no standing with NZQA or any educational institution. Teachers retain full professional responsibility for every grade they award. NZGrader makes no warranty that its suggestions will align with NZQA moderation outcomes.

4. Credits and Billing

4.1 Credit System

The Service operates on a credit-based model. Each marking or feedback request consumes one credit. Credits are allocated according to your subscription plan and do not roll over between billing periods unless otherwise stated.

4.2 Plans

  • Teacher PRO — NZD $39/month, includes 100 credits
  • Student PRO — NZD $12/month, includes 15 credits
  • Free Student Tier — 3 credits per month at no charge

4.3 Overage

If you exceed your included credits, additional credits are charged at NZD $0.20 per credit. Overage charges are added to your next billing cycle.

4.4 Billing

Subscriptions are billed monthly in advance. Payment is processed on the same date each month from your subscription start date.

4.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No partial refunds are issued for unused time within a billing period.

4.6 Refunds

Refunds are not available for consumed credits or elapsed subscription periods. If you believe you have been incorrectly charged, contact us at support@nzgrader.com within 14 days and we will investigate. Nothing in this clause limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

5. Privacy and Data

5.1 Privacy Act 2020

We are committed to complying with the Privacy Act 2020 (NZ). Our full Privacy Policy, which forms part of these Terms, sets out in detail how we collect, store, use, and disclose personal information.

5.2 What We Collect

We collect account information (name, email, role), submitted content (student work, assessment criteria), generated feedback, usage data, and technical data (browser, device, IP address).

5.3 Offshore Processing

To deliver the Service, submitted content is processed by third-party AI providers who may be located outside New Zealand. By using the Service, you acknowledge and consent to this transfer. We take reasonable steps to ensure offshore providers maintain appropriate data protection standards.

5.4 Data Retention and Submission History

Submitted content and generated feedback are stored indefinitely to power the submission history feature, which allows users to review past work and feedback within their account. This data remains stored for as long as your account is active.

You may delete individual history entries at any time through your account settings. You may also request deletion of all your stored content by contacting us at support@nzgrader.com. We will action deletion requests within 10 business days.

On account closure, all stored content and history is permanently deleted within 90 days unless you request earlier deletion.

5.5 AI Training

With your explicit consent, anonymised and de-identified versions of submitted content may be used to improve the accuracy and performance of NZGrader's AI models. This consent is opt-in and can be withdrawn at any time through your account settings. Withdrawing consent does not affect data already used prior to withdrawal.

5.6 Teacher Responsibility

Teachers and schools who submit student work are responsible for ensuring they have the appropriate authority to do so, including any required consent from students or parents under their school's own policies. WordFrame is not responsible for a user's failure to obtain appropriate permissions before submitting student work.

6. Acceptable Use

You agree not to:

  • Submit work that is not your own or that you do not have authorisation to submit
  • Use the Service for any purpose other than NCEA assessment support
  • Share your account credentials with others
  • Attempt to reverse-engineer, copy, or replicate any part of the platform or AI models
  • Scrape, harvest, or extract data from the Service by automated means
  • Use the Service in any way that violates New Zealand law or the rights of any third party
  • Attempt to circumvent any access controls, security features, or usage limits

We reserve the right to suspend or terminate accounts that breach these conditions without notice.

7. Academic Integrity

NZGrader is designed as a learning and professional tool. It is intended to help students understand NCEA criteria and improve their work before submission, and to assist teachers with marking workload.

Students must not submit AI-generated content as their own original work in any NCEA assessment. Using NZGrader to get feedback on a draft is acceptable; submitting work written or substantially rewritten by an AI as your own is not, and may constitute academic dishonesty under your school's policies and NZQA's rules.

WordFrame accepts no responsibility for how users choose to use feedback generated by the Service.

8. Intellectual Property

8.1 Our IP

All rights in the NZGrader platform, including its design, software, AI models, methodology, branding, and content, are owned by WordFrame. Nothing in these Terms grants you any licence to use our intellectual property beyond what is necessary to use the Service as intended.

8.2 Your Content

You retain ownership of all content you submit. By submitting content, you grant WordFrame a limited, non-exclusive licence to process that content for the purpose of delivering the Service and storing it for your submission history, and (where you have given consent under clause 5.5) to use de-identified versions for AI improvement purposes.

8.3 No Affiliation with NZQA

NZGrader is an independent tool. We are not affiliated with, endorsed by, or connected to NZQA, the Ministry of Education, Young Enterprise Scheme, or any school or kura.

9. Limitation of Liability

9.1 General Limitation

To the maximum extent permitted by New Zealand law, WordFrame's total liability to you for any claim arising out of or in connection with the Service is limited to the total fees you paid to us in the 12 months preceding the claim.

9.2 Exclusion of Consequential Loss

We are not liable for any indirect, consequential, or special loss, including but not limited to: a student receiving an unexpected NCEA grade, a teacher's assessment being moderated differently by NZQA, loss of data, or loss of income.

9.3 Consumer Guarantees

Nothing in this clause excludes or limits any rights you have under the Consumer Guarantees Act 1993 that cannot be lawfully excluded. If you are acquiring the Service for business purposes, you agree that the Consumer Guarantees Act does not apply to your use.

10. Disclaimer on AI Accuracy

The Service uses artificial intelligence to generate grade suggestions and feedback. AI-generated outputs may contain errors, omissions, or misjudgements. NCEA marking requires professional human judgment and NZGrader is a tool to assist that judgment, not replace it.

We make no representation that grade suggestions will be consistent with NZQA's marking schedules, exemplars, or moderation decisions. Teachers should exercise their own professional judgment when using NZGrader outputs.

11. Termination

11.1 By You

You may close your account at any time through your account settings. Closing your account cancels your subscription at the end of the current billing period.

11.2 By Us

We may suspend or terminate your account immediately if you breach these Terms, if we are required to do so by law, or if we reasonably believe your use of the Service poses a risk to other users or to the platform.

11.3 Effect of Termination

On termination, your access to the Service ceases. All stored content and submission history will be permanently deleted within 90 days of account closure, unless you request earlier deletion by contacting support@nzgrader.com.

12. Changes to These Terms

We may update these Terms from time to time. For material changes, we will give you at least 30 days' notice by email or by a prominent notice within the platform. Your continued use of the Service after that notice period constitutes acceptance of the updated Terms.

If you do not accept updated Terms, you must stop using the Service and close your account before the changes take effect.

13. Complaints and Disputes

If you have a complaint about the Service, please contact us first at support@nzgrader.com. We will acknowledge your complaint within 5 business days and aim to resolve it within 20 business days.

For privacy-related complaints that we are unable to resolve, you may contact the Office of the Privacy Commissioner at privacy.org.nz.

For general disputes we are unable to resolve directly, both parties agree to attempt mediation in good faith before pursuing any court proceedings.

14. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes that cannot be resolved by mediation will be subject to the exclusive jurisdiction of the New Zealand courts.
